This Study Participation Agreement, Consent and Release (“Consent & Release”) contains the terms and conditions for your participation in a Two Week Baseline on your current cannabinoid use (the “Study”). The Two Week Baseline study is organized by The Network of Applied Pharmacognosy (NAP) (“Sponsor”) and the Study is conducted using technologies and an online platform provided by MoreBetter Ltd. (“MoreBetter”). Sponsor and MoreBetter are collectively referred to this Consent & Release as the “Sponsors”).

When you click the box to confirm that you have read and agree to the terms of this Consent & Release, it becomes a contract between you and the Sponsors. You are making the representations and agreeing to the terms conditions of participating in the Study set out below in this Consent & Release.

Representations of Participant

I will knowingly and freely participate in the Study to the best of my ability and intend to participate in the Study through its completion.
I am healthy enough to participate in the Study and understand that I should consult with my provider prior to participating in the Study, if at any time I have questions or concerns about my health or medical condition, and before making any decisions about my health based on any information I receive through the Study.
I understand that the information I provide for purposes of the Study, which will include my health and other sensitive personal information, will be shared with the Sponsors and used by them for the Study and other purposes to advance product development, marketing, and research initiatives.
I understand that the Sponsors may retain and use for an indefinite period on an aggregated or anonymized basis any data derived from information I provide for the Study.
I understand that Sponsors will contact me by text, e-mail, or voice call at any email address and/or telephone number I provide to the Sponsors for the following purposes (a) Study questions, reminders, and results, (b) information about Sponsors products and services, and (c) other study opportunities.
I understand that by participating in the Study and providing my self-reported information, I acquire no rights in, or receive any compensation for, my participation in the Study of any research or commercial products that may be developed by the Study or the Sponsors.
I confirm that I am not an employer or insurance company attempting to obtain information about an insured person or an employee.
I am over 18 years of age.

I have been given the opportunity to ask questions and receive answers about the Study and to obtain independent provider and legal advice of my choice prior to signing this Consent and Release.
I understand that I may terminate my participation in the Study at any time by replying STOP to any text message sent to me with questions for the Study and that if I terminate my participation in the Study, the Sponsors will retain the right to use my personal data as provided in this Consent & Release and permitted by applicable law.

Agreements of Participant

Release. I hereby release, discharge and agree to save harmless the Sponsors and their respective officers, partners, shareholders, directors, employees, licensees, legal representatives and assigns, from any liability with respect to any cause of action arising out of my participation in the Study and distribution and use of studies, findings or data relating to the Study, including without limitation any claims for invasion of privacy.
Risk. I AM PARTICIPATING IN THE PROJECT AT MY OWN RISK. THE PRODUCT IS PROVIDED "AS IS," WHERE IS, WITH ALL FAULTS AND WITHOUT ANY WARRANTY OR CONDITION OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY. THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORTS IS WITH ME. THE SPONSORS SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF FITNESS FOR PARTICULAR PURPOSE, MERCHANTABILITY, QUALITY, ACCURACY OR TITLE.*
Limitation of Liability. IN NO EVENT SHALL THE SPONSORS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUE, REGARDLESS OF WHETHER THEY KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES, AND IN NO EVENT SHALL THEIR TOTAL CUMULATIVE LIABILITY TO ME OR ANY THIRD PARTY UNDER THIS AGREEMENT EXCEED $100.*

* The above disclaimers or limiting implied warranties and/or limitation of liability for incidental or consequential damages will not apply where prohibited or superseded applicable local law.

Indemnification. I agree to indemnify, defend and hold the Sponsors harmless from and against any and all claims, demands, actions, costs, liabilities, losses and damages of any kind (including attorneys' fees) resulting from: (i) my participation in the Study; (ii) my breach of any provision of this Consent and Release; (iii) the illegality, reliability, appropriateness, originality or copyright of any information I submit to the Study or the Sponsors; and/or (iv) any intentional wrongdoing by me.
